Biohacker community labs operate with no federal biosafety oversight despite handling BSL-2 organisms

Community biology labs (Genspace NYC, BioCurious, Counter Culture Labs) are member-funded spaces where hobbyists conduct genetic engineering experiments. Some work with BSL-2 organisms (E. coli K-12 derivatives, yeast expression systems) under voluntary safety guidelines with no federal inspection or licensing requirement. A biohacker ordering CRISPR kits from Addgene and working in a community lab has fewer regulatory requirements than a university undergraduate doing the same work in an institutional lab. This persists because the NIH Guidelines for Research Involving Recombinant DNA only apply to NIH-funded institutions, and community labs receive no federal funding, placing them entirely outside the biosafety regulatory framework.
